1. This prize draw is organised and promoted by Vimage Media (Pty) Ltd., trading as MomSays (herein after referred to as “MomSays” or “the promoter”), a South African Company.
2. The independent auditor shall be Section Thirty Five Legal and Business Solutions (Pty) Ltd who shall select a winner at random. The winner shall be selected by choosing a random number within the range of registered profile ID’s.
3. The free prize draw is open to all fans of the MomSays page, who are Residents of South Africa (being in possession of a valid South African identity document or passport) and over the age of 18 (or if a minor,must be duly assisted by their legal guardians).
4. However, if you are an director, member, partner, employee or agent of MomSays (or its parent, subsidiaries or any affiliated company) or are otherwise associated with the prize draw, you and any member of your family or any agent are not eligible to enter.
5. By entering the prize draw, you are deemed to have read and accepted these terms and conditions. All entry instructions form part of these terms and conditions. The promoters decision regarding any issue with the competition will be final and binding and no correspondence will be entered into.
6. In order for an entry to qualify as an valid entry into the competition, one will need to register and complete ones profile on the MomSays website.
7. A list of prizes shall be made available on the MomSays website and shall be forwarded to interest parties upon request. Said list shall further be made available on the social media page which has been created specifically to facilitate the competition.
8. Prizes shall be drawn each week, with a grand prize which shall be drawn at the end of the competition. Each week five prizes shall be drawn, with five winners selected weekly accordingly.
9. The competition shall run from 13th May 2019 to 17th June 2019.
10.No responsibility will be accepted for any entry that is not delivered, received or is delayed or damages due to technical reasons, including telecommunication failure on the part of the participant’s service provider, or otherwise. Proof of sending is not proof of receipt.
11.The winner will be responsible for any additional costs incurred in taking advantage of their prize.
12.If the winner is chosen and there are noted irregularities (i.e. the email address or person does not exist, is not delivered to a person, or is forwarded to a person with a different identity etc.) the winner will be disqualified and a new winner will be drawn.
13.Any entries received after the closing date will be invalid. MomSays accepts no responsibility for any errors of any other kind which may restrict or delay the sending or receipt of an entry, or for delayed or lost entries.
14. If we are unable to contact a prize winner, we reserve the right to pick another.
15. All entries will be examined and the prize shall be awarded to the winner selected at random by MomSays from all eligible participants who have correctly entered the prize draw in accordance with entry instructions. No correspondence will be entered into.
16. The winners will be notified via Facebook, email or phone call, and the prizes will be issued as soon as possible
17. Prizes are not redeemable for cash.
18. MomSays reserves the right to substitute any prize for another prize of like value at any time and for any reason.
19. The prize may itself be subject to certain terms and conditions. The winner is solely responsible for complying with such terms and conditions.
20. Logistical elements, together with the delivery of the prizes are managed by third parties and no liability in any form whatsoever shall be held by MomSays once the prize has been handed to said third party.
21. Details of the winners will be made available on request to those enclosing a stamped addressed envelope (MomSays, ADDRESS) within six weeks.
22. MomSays reserve the right to cancel or change the promotion at any time and will endeavour to give you advance notice of any such change or withdrawal. However, in some cases, advance notice may not be possible.
23. Participants accept that if they breach these rules they will be disqualified and their prizes will be revoked even if the prize has been issued prior to discovering breach of terms.
24. Under no circumstances will MomSays (or its parent, subsidiaries and affiliated companies) be liable for any losses, damages, costs or expenses arising from or in any way connected with any errors, defects, interruptions, malfunctions or delays in the promotion or the prize.
25. Any problems arising from physical damage or neglect to prizes on the part of the prize winner or their acquaintances will not be covered by the manufacturers warranty or MomSays.
26. By entering, a participant acknowledges that personal information about the participant will be shared with the promoters and their agents to the extent necessary to conduct the competition and for prizes to be delivered to prize winners.
27. All personal information relating to the participants will be used solely in accordance with South African consumer and data protection legislation.
28. The Promoters reserve the right to shorten, extend, suspend the time period of the competition or terminate the competition whenever it should so choose for technical, commercial, or operational reasons, or for reasons beyond the control or generally for any reason whatsoever within their sole discretion. The competition, its pries and terms and conditions may be amended by the promoters, at any time during the competition, and will be applied and interpreted within their sole discretion. In such an event, all participants waive any rights that they may have/purport to have in terms of this competition, and acknowledge that they will have no recourse against the promoters whatsoever.
29. All entries and any copyright subsisting in the entries become and remain the property of the promoter who may publish or cause to be published any of the entries received.
30. Winners are required to provide MomSays with a Copy of their ID (South African Identification Document) to receive their prize.
31. Winners are required to provide MomSays a picture of themselves (with their prize, if applicable) within 7 days of receipt of the prize.
32. Failure to do so will constitute a breach of the terms and conditions and thus your prize will be revoked.
33. The terms and conditions are governed by the laws of South Africa
